Final phase of operationalisation of the Criminal Procedure (Miscellaneous Amendments) Act 2024

The Criminal Procedure (Miscellaneous Amendments) Act 2024 was passed in Parliament on 5 February 2024 and has been operationalised in phases. The final phase of operationalisation, which will comprise amendments introducing the Sentence for Enhanced Public Protection (SEPP) and Sentence for Public Protection (SPP), will come into effect on 31 July 2026.

The Criminal Procedure (Miscellaneous Amendments) Act 2024 was passed in Parliament on 5 February 2024 and has been operationalised in phases. The final phase of operationalisation, which will comprise amendments introducing the Sentence for Enhanced Public Protection (SEPP) and Sentence for Public Protection (SPP), will come into effect on 31 July 2026.

The amendments that will come into effect will include: 

  1. Amendments to introduce the Sentence for Enhanced Public Protection (SEPP) as a new sentencing regime for dangerous offenders who have committed a serious violent or sexual offence with a substantial risk of re-offending. The SEPP will allow such offenders to be detained for as long as is needed for public safety, while ensuring safeguards such as expert risk assessments and regular reviews of the offender’s suitability for release.
  2. Amendments to repeal the existing Corrective Training and Preventive Detention regimes, which will be replaced by the Sentence for Public Protection (SPP). This streamlines the sentencing options available for recalcitrant offenders.

The amendments will apply only to offences committed on or after 31 July 2026.
