Phase 4 Commencement of the Criminal Procedure (Miscellaneous Amendments) Act 2024

The Criminal Procedure (Miscellaneous Amendments) Act 2024 was passed in Parliament on 5 February 2024, and the amendments have been rolling out in phases. The fourth phase of amendments, which comprises the amendments relating to investigation powers, comes into effect on 26 May 2025.
The Criminal Procedure (Miscellaneous Amendments) Act 2024 was passed in Parliament on 5 February 2024, and is being rolled out in phases.
The Act advances our criminal justice system and contains amendments aimed at:
- protecting the public by strengthening our levers to tackle crime, including serious sexual crime, and
- enhancing transparency, fairness and coherence in our criminal court processes.
The following amendments will come into effect on 26 May 2025:
- Empowering prescribed non-Police law enforcement agencies to investigate bail and absconding offences arising from the predicate offences under their purview; and
- Setting out a legislative framework on the conduct of forensic medical examinations to provide clarity and to allow more effective criminal investigations.
